Awareness Against Human Trafficking (HAART) is a non-governmental organization based in Nairobi and dedicated to fighting human trafficking in Eastern Africa. HAART works through a multi-disciplinary approach applying the UN Four Ps strategy to combat trafficking in persons: Prevention, Protection, Prosecution, Policy and Partnership. HAART is one of the key counter trafficking organizations in Kenya addressing the issue of human trafficking by supporting the people most affected by it and also developing best practices in the movement.
HAAT Kenya is currently recruiting for the position of a Legal Counsel. The Consultant shall coordinate, manage and handle (including legal representation) HAART’s Constitutional Petition case that has been instituted at the High Court of Kenya. The Consultant is to ensure that the management of the Constitutional Court case is upheld and coordinate and regularly/frequently engage with the HAART Management team on the court process from the legal strategies & actions that shall be undertaken/adopted till conclusion of the court case.

Assignment
The role of the Consultant shall be multifaceted and shall involve representing the organization in court as well as prepare legal briefs, opinions and strategies that shall be undertaken in response to the Constitutional case. The Consultant shall also share regular updates with HAART Management on the progress of the case.

Specific tasks and Deliverables
• Attend the High Court case proceedings and provide legal representation on the same.
• Regularly share after court session updates with HAART Management.
• Development and implementation of legal strategies pertaining to the Constitutional Petition case
• Preparation of case plan, legal brief and opinion.
• Manage and develop clear pathways for ensuring that the Constitutional Petition case proceeds until conclusion
• Regularly inform HAART’s Management on the progression of the case and communicate legal strategies that shall be adopted for the case
• Close collaboration, engagement and coordination with HAART staff and Board in the handling of the court case.

Essential criteria and qualification
• Bachelor’s degree in Law
• An advocate of the High Court of Kenya
• A proven track record of a minimum of 5 years’ experience of handling complex legal cases with particular focus on Constitutional Law.
• Experience in human rights law (documented experience in Constitutional Law)
• Experience in legal representation, research and developing court submissions in handling the legal case
• Experience in developing legal strategies.
• Excellent organizational skills, ability to plan and communicate effectively on the case and anything related to the case.
• Excellent relationship management and interpersonal skills and proven ability to build and manage clients
• Experience in developing, writing and submitting submissions in relation to court cases
• Excellent communication, writing and presentation skills- innovative/creating thinker.
• Highly self-motivated and able to drive initiatives as well as collaborating with teams.
