THE ASSIGNMENT

To ensure the full and coordinated functioning of the Commercial Justice Court Users Committees (CJCUCs), a comprehensive analysis of the existing operational framework is necessary. This will facilitate the development of guidelines and plans that standardises CJCUCs operations to ensure efficiency and responsiveness. 

IDLO, in partnership with the NCAJ, seeks to engage a consultant to develop the CJCUC Guidelines and an Operational Plan.

The Consultant’s duties and responsibilities will include:

  • Conducting a comprehensive operational analysis of CJCUCs as currently set up under NCAJ and identifying contextual and operational gaps taking into account the scope, structure, access, utility, and sustainability of CJCUCs.
  • Guided by the findings of the operational analysis, develop draft CJCUC Guidelines and Operational Plan as appropriate.
  • Present the draft Guidelines and Operational Plan for review during stakeholders’ meetings convened by CJCUCs in Nairobi, Kisumu, Mombasa, Nakuru, and Eldoret, in consultation with NCAJ and IDLO.
  • Incorporate the feedback consolidated from the NCAJ Secretariat and the stakeholders’ meetings and develop the final drafts of the CJCUC Guidelines and Operational Plan.
  • Align the CJCUC guidelines with the CUC monitoring & reporting tools and systems.
  • Finalise and present the CJCUC Guidelines and Operational Plan developed to NCAJ and IDLO in a ready-to-print format.
  • Conduct a validation workshop of the final drafts with CJCUCs and stakeholders.

DELIVERABLES

The Consultant will deliver the following:

  • An inception report detailing the understanding of the assignment, methodology, milestones and timelines, work plan, risks, and mitigation measures.
  • An operational analysis report of CJCUCs is currently set up under NCAJ with clear proposals/recommendations to address identified gaps.
  • A compilation of the information sources relied upon in the development of the documents.
  • Final drafts of the CJCUC Guidelines and Operational Plan developed.
  • A final report detailing the accomplished work, processes, challenges, and lessons learned.

Ideal Candidate Profile

Education

  • A Bachelor’s Degree in law, economics, strategic planning, public policy, organisational development, or any other relevant field of study.

Work experience

  • A minimum of 5 years of professional development.
  • Demonstrated understanding and experience in the business and investment environment.
  • Exposure ease of doing business indices for Kenya.
  • Demonstrated experience delivering on assignments of a similar nature.
  • Understanding of the commercial justice sector.

Technical competencies

  • Demonstrated competencies in public policy development, including experience in developing guidelines or monitoring tools.
  • Excellent analytical, writing, and editing skills.
  • Excellent work ethic founded on integrity, impartiality, and confidentiality principles.
  • Proficiency in Microsoft Office programs and other relevant computer applications.
