Manager, Regulatory Compliance & Ethics
Position Scope: The job holder is responsible for assisting the Head of Compliance in the overall coordination and implementation of the Bank’s overall compliance with applicable laws, rules, regulations/statutory and internal policies requirements, and ethics and integrity programs.
He/she will also have reasonable access to all the Bank activities, records, property and personnel necessary to fulfil the duties and responsibilities of the position.
Key Responsibilities:
• Prevent compliance breaches and reputational risk from occurring, which could result in financial penalties through reviewing the adequacy and effectiveness of controls.
• Ensure compliance standards are met and risks are mitigated. Identify, define and agree on the regulatory universe applicable for each relevant Business Unit and risk mitigation plans.
• Monitor and provide assurance on the adherence to compliance practices in the frontline business to ensure compliance risks are managed and reported across the Bank.
• Ensure compliance risks are adequately addressed.
• Provide advice to minimize regulatory; reputational and Compliance risk and endeavor to avert potential litigations/ penalties through the proactive management of Compliance Breaches and Regulatory matters.
• Advise business of changes and identify potential impact of these changes on the business.
• Enable management to make informed decisions and prevent compliance breaches.
• Ensure enhancement of business processes and methodologies to reflect the operating business regulatory environment.
• Consult on and advise the business areas regarding relevant local and international legislation; compliance and governance to ensure adherence to relevant codes; regulations and rules thereby minimizing risk to and protecting the reputation of the Bank.
• Conduct compliance risk and control assessments (CRA’s).
• Test whether the business control is effective and adequate and ensure that business policies contain the right content addressing legislative requirements
• Execute the annual Compliance risk-based program.
• Contribute to a culture of compliance transformation to ensure an appropriate compliance culture is embedded supporting the overall business strategy.
• Obtain buy-in for developing new and/or enhanced processes that will improve the functioning of the stakeholder’s business.
• Compile Compliance reports, both to senior management and the board.
• Review compliance policies and procedures on a regular basis to ensure they conform to statutory and regulatory requirements.
• Provide timely and insightful assessment of regulatory policy developments and share with the businesses.
• Design, implements, and manages the Bank’s strategic engagement with regulatory policy makers and related external stakeholders.
• Engage with stakeholders on findings of compliance risk and control assessments.
• Work closely with business leads to prepare the Bank’s internal and external positions vis-à -vis emerging regulatory policy issues. This includes leading on drafting consultation responses to the regulators.
• Support in the coordination and implementation of good ethical behavior in the way the Bank conducts its businesses and ensure adherence to the best business practices.
• Take personal responsibility for embedding the highest standards of ethics, including regulatory and business conduct, across National Bank. This includes understanding and ensuring compliance with, in letter and spirit, all applicable laws, regulations, guidelines and the Bank and KCB Group Code of Conduct.
• Support Bank Regulatory Affairs to achieve the outcomes set out in the Bank’s Conduct Principles.
• Identify opportunities for the team to use technology to improve its analytical capabilities and develop new communication formats.
Education, Professional Qualifications, Experience & Skills
• Bachelor’s degree in Information Technology, Legal, Risk Management or business related field from a recognised university.
• Professional Certification in CISA, CISM, CRISC, CDPSE or; CIPP/CIPM
• Masters degree in Data Management or a business related field will be an added advantage.
• At least 6-8 years’ working experience within risk management, internal audit, compliance, 4 of which should be in Data Privacy laws within the region and/or EU Data Privacy laws.
• Working experience in Risk, Compliance or Legal function, with recent experience in privacy compliance.
• Conversant with Banking regulatory requirements
• Experience in Branch Operations.
• Expertise in MIS.
• Knowledge of AML/KYC policy
• Excellent analytical skills.
• Excellent report writing skills
• Good Inter-personal sensitivity.
• Action and result orientation.
• Excellent communication & inter-personal skills
• Good presentation skills
