JOB DETAILS:
10. Manager, Legal Affairs (Policy & Litigation) – TWO (2) POSITIONS- NPSC SCALE 6- V/No. 12/2022
Gross Salary Scale: As per NPSC Salary Scale
Leave allowance: As existing in the Commission
Annual Leave: 30 working days per financial year
Medical Cover: As existing in the Commission
Terms of Service: Permanent and Pensionable
a) Duties and responsibilities Managerial Responsibility
i. Manages the continuous legal review of Legislation and Regulations on
the mandate of the Commission;
ii. Manages the handling of appeals submitted to the Appeals Committee of the Commission;
iii. Initiate the development of policies on legal affairs and procedures of the Commission;
iv. Liaises with the legal service providers in legal and policy development, litigation and advocates;
v. Supervises prompt implementation of the Sections work plans;
vi. Supervises the proper utilization of the units’ annual budget;
vii. Implements findings on research on legal and regulatory issues within the mandate of the Commission;
viii. Supervises the drafting of contracts, agreements and other legal documents between the Commission and third parties;
ix. Develops proposals for reforms on emerging legal policies and issues; and
x. Manages the Litigation cases at the Commission.
Operational Responsibility
i. Implements performance appraisal systems of the Directorate;
ii. Interprets laws and regulations;
iii. Supervises the implementation of Policy, Legal, Litigation strategies in matters the Commission is involved in;
iv. Develops the tools for monitoring the Commission’s compliance with
regulatory and legislative requirements;
v. Identifies training needs within the department;
vi. Organizes interactions with stakeholders with regard to Policy, Legal, Litigation and Appeal matters;
vii. Designs legal and policy documents, opinions, advisories and briefs;
viii. Provides legal advice to Sections in the Commission for implementation;
ix. Implements standards and procedures in accordance with relevant international instruments, national legislation and regulations;
x. Undertake sensitization on relevant legal and policy issues to the Commission;
xi. Coordinate the provision of legal opinions on Appeal cases to ensure compliance with the set criteria and procedures; and
xii. Prepares units’ budget estimates.
(b) Requirements for Appointment
i. Bachelors Degree of Law (LLM Degree) from a recognized institution;
ii. Diploma in law from Kenya School of Law, Counsel of Legal Education or any other recognized institution;
iii. Admitted as an Advocate of the High Court of Kenya;
iv. A Management Course lasting not less than four (4) weeks from a recognized institution;
v. Be a Certified Public Secretary (K) or its equivalent qualifications from a recognized institution;
vi. Be a member of the Law Society of Kenya; and
vii. Meet the requirements of chapter six of the Constitution of Kenya.
