JOB DETAILS:
6. Deputy Director, Appeals, Policy And Legal Affairs (Commission Management Support Services (CMSS) –ONE (1) POSITION-NPSC SCALE 7 - V/No.8/2022
Gross Salary Scale: As per NPSC Salary Structure
Leave allowance: As existing in the Commission
Annual Leave: 30 working days per financial year
Medical Cover: As existing in the Commission
Terms of Service: Permanent and Pensionable
(a) Duties and Responsibilities Strategic/ Policy Responsibilities
i. Identify issues and areas for Policy Formulation and reform;
ii. Undertake law and Policy reviews;
iii. Coordinate and implement work plans for the Directorate;
iv. Develop legal policies and procedures to ensure that they are in accordance with the existing legislation;
v. Monitoring compliance with regulatory and legislative requirements;
vi. Keeping custody of the records of the Commission Meeting and the preservation of original documents;
vii. Provide day to day legal and regulatory support to the functional areas covering general compliance queries and reviews;
viii. Liaising with external lawyers on all cases filed against the Commission to ensure instructions, witnesses and statements are procured on time;
ix. Participate in the institution budgeting process in accordance with the midterm expenditure framework;
x. Lead and contribute to collaboration with other units within the NPSC on intersecting areas of work;
xi. Participate in the development of policy analysis standards and procedures in accordance with relevant government regulations to ensure achievement of set standards.
xii. Mentor and coach staff within the Directorate to enhance work performance as set out in the appraisal schemes;
Managerial Responsibilities
i. Preparing Commission Meeting Resolutions, Action Points, Board Reports and Board Minutes;
ii. Undertake research on legal issues and advice the Commission on the same;
iii. Attend Commission meetings and communicate resolutions of the Commission to the Heads of Departments and Sections for timely action;
iv. Take Minutes of the Commission meetings in a timely manner and ensuring their circulation;
v. Drawing and vetting of Contracts, agreements and other legal documents;
vi. Implement performance appraisal systems of the directorate;
vii. Follow up on cases filed against the Commission and assist preparation of legal reports and opinions;
viii. Implementation and realization of the Strategic Plans and objectives in the Directorate;
ix. Ensure individual staff annual work plans are implemented and are within the estimated budget, timelines and quality standards to achieve effective and efficient performance in the directorate;
x. Monitor and track compliance with policy, regulation, standards and guidelines; and
xi. Facilitate dissemination, translation and implementation of Policy and Legal research findings.
(b) Requirements for appointment
i. Master Degree in any of the following disciplines; Law, Business Administration, Public Administration, or equivalent qualifications from a recognized institution;
ii. Postgraduate Diploma in Legal Studies from the Kenya Scool of Law, Council of Legal Education or from any recognized institution;
iii. Be admitted as an advocate of the High Court of Kenya;
iv. Be a Certified Public Secretary (CPSK) or its equivalent qualification from a recognized institution;
v. Be a member of a Professional body;
vi. A Management Course lasting not less than four (4) weeks from a recognized institution;
vii. Twelve (12) years of service of which three (3) should be in a comparable position from a reputable organization; and
viii. Meet the requirements of Chapter Six of the Constitution of Kenya.
