Project Background
The Network of African Human Rights Institutions (NANHRI) joins the regional and international human rights community in recognising discrimination, stigma and violence perpetuated against persons, including non-citizens such as refugees on the basis of their real or perceived sexual orientation, gender identity and expression (SOGIE) in Africa. NANHRIs commitment to this emerging and critical human rights issue is derived from regional and international commitments and principles that are anchored in National Human Rights Institutions mandates of protecting the rights of marginalised and vulnerable groups and/or individuals. On the continent, the African Commission on Human and Peoples’ Rights adopted Resolution 275 – Protection against Violence and other Human Rights Violations on the basis of their real or imputed Sexual Orientation and Gender identity during the 55th Ordinary Session (Luanda, Angola). It is on the basis of Resolution 275 that NANHRI conceptualised and premised the Sexual Orientation and Gender Identity (SOGIE) Project.
Since 2016, NANHRI has been implementing the SOGIE Project that seeks to develop the capacity of African NHRIs to understand and effectively respond to violations of the rights of Lesbian, Gay, Bisexual/ Intersex, Trans-Gender and Non-Conforming (LGB/ITGNC) persons and to build meaningful ties and relationships between the NHRIs and the LGB/ITGNC CSOs and community. The pilot phase (2017-2018) and the Phase II (2019-2020), engaged the NHRIs of five countries: Kenya, Uganda, Ghana, South Africa, and Malawi. The project involved formal training curriculum, in-country workshops, thematic workshops and forums and continues to offer technical support to NHRIs.
The successful completion of these phases created more avenues for expansion; the project seeks to involve the NHRIs of Liberia, Nigeria, Namibia, Côte d’Ivoire and Togo. The rationale for selecting the five States was based primarily on the findings of the Rapid Assessment conducted by NANHRI and completed in March 2020. The Rapid Assessment established the extent to which internal policies, practices and attitudes of NHRI staff across all levels support or hinder implementation of Resolution 275; found out the extent to which respective NHRIs have been collaborating with external actors in the implementation of Resolution 275; determined the willingness of respective NHRIs to be incorporated into the SOGIE Project.
It is based on this background that NANHRI seeks to conduct a baseline study of the five NHRIs to enable better conceptualisation of the rollout of Phase III of the SOGIE project. The findings of the baseline will also assist in monitoring and evaluating the progress of the NHRIs as the implementation continues.

Scope Of Work **
The Consultant shall be responsible for undertaking a baseline study on the five NHRIs (Liberia, Nigeria, Namibia, Côte d’Ivoire and Togo).
With a specificity around:
• Understanding the selected NHRIs understanding and engagement with SOGIE issues and Resolution 275.
• Determining the level of capacity/ institutionalisation of SOGIE rights that is its implementation structure.
• Reviewing laws and policies within the target countries on their provisions on SOGIE
• Identifying challenges and gaps ensure successful institutionalisation of SOGIE issues
• Identifying focal persons within the NHRIs who will lead implementation of the SOGIE work

Main Tasks Of The Consultant
In ensuring achievement of the baseline study the Consultant will therefore undertake the following tasks:
• Conceptualise the research design and methodology for the baseline study; in consultation with the Programs Officer and Senior Programs Officer.
• Undertake desk reviews and all necessary preparations in readiness for the baseline study
• Visit NHRIs for the collection of data
• Data cleaning and analysis
• Develop narrative report on the findings of the baseline study.

Deliverables
The Consultant shall be required to submit the following to NANHRI:
An inception report detailing the design and planned execution of the baseline study
Under this deliverable, the Consultant will:
• In consultation with the programs officer, design the baseline study methodology, sampling plan, data collection tools
• Develop a practical work plan for the execution of the baseline study as per the agreed timelines
• Suggest a structure for the report

Undertake the baseline study
Under this deliverable the Consultant shall:
• Assume the overall leadership in the data collection exercise
• Conduct country visits for the collection of data
• Ensure collection of accurate information for the agreed deliverables
• Ensure diligence in handling and management of collected data

iii. Production of report
Under this deliverable the Consultant shall:
• Analyse the data
• Submit an interim report for review by Programs Officer and the Senior Programs Officer.
• Submit a baseline report in soft and hard copy

Duration Of The Consultancy
For the purpose of this contract, the period of consultancy is 20 days, scattered within the period of May through to June 2021.

Qualification Of The Consultant
The Consultant to undertake this baseline should have the following qualifications
• Demonstrable understanding of SOGIE matters and programming within the African Context
• Demonstrable experience in conducting baseline studies, impact assessments or other types of programme evaluation studies/research on SOGIE.
• Knowledge and practical experience in quantitative and qualitative research methods. **
• Should be able to communicate effectively in English and French

Quality Of Work
NANHRI will control the quality of work produced and reserves the right to determine the final outcome.**

Engagement
i. In the execution of this assignment and any related clarification, the Consultant will work with Program Officer in charge of this project to ensure successful completion.
ii. The Consultant so contracted shall not enter into any contract with any party and/or organization that might affect their delivery/presentation on the dates as aforementioned.
iii. Upon completion of the assignment, both parties have liberty to terminate this contract. NANHRI shall pay the Consultant within one month and no further claims shall be forwarded to the NANHRI, over and above the dues entitled to the Consultant as provided by this contract.
iv. The Consultant assumes full liability for any personal injury, loss or damage including loss, damage or injury to third parties which they may cause, provided that such liability cannot be directly attributable to wilful action or negligence of NANHRI, during the period of the contract.
v. Any amendment to this contract shall be in writing and mutually agreed upon by the contacting parties.
vi. Any material developed for or from the said activity shall remain the property of the NANHRI.
