JOB DETAILS:
The International Foundation for Electoral Systems (IFES) is an international non-profit organization that supports the building of democratic societies and primarily works in the areas of democratic governance and electoral management body support. IFES promotes democratic stability by providing technical assistance and applying field-based research to the electoral cycle in countries around the world to enhance citizen participation and strengthen civil societies, governance and transparency. Founded in 1987 as a nonpartisan, non-profit organization, IFES has developed and implemented comprehensive and collaborative democracy solutions in more than 145 countries. IFES is currently implementing a project in Kenya. IFES seeks a national legal researcher to support the Judiciary Committee on Elections (JCE) Secretariat in undertaking its mandate. It is expected that the Legal Researcher will be working full time in this role embedded in the JCE for a period of 3-6 months. This is a temporary mid-level position in the JCE. The Researcher will work full time with the Secretariat to coordinate the work of the JCE, research on legislative reforms, tracking the EDR processes in the 2022 electoral cycle and support capacity building activities.

Duties and Responsibilities:
• Under this consultancy, the Legal Researcher shall have the following duties and responsibilities:
• Support the JCE Secretary in the daily coordination of JCE legal and operational activities
• Support the JCE Secretariat in the areas of coordinating programmatic activities including implementation, monitoring and reporting
• Undertake research on EDR as required by the Secretariat, the JCE Members;
• Assist the JCE Secretariat in organizing and coordinating program activities including Workshops; Training Forums; Liaison with Stakeholders and organs of the Judiciary;
• Support the JCE Secretariat in the development of concepts, prioritization of activities and M&E reports
• Support the JCE Secretariat in Tracking progress in resolution of election related disputes in the 2022 election cycle both at pre-election and post election stages and to compile monitoring reports for dissemination.
• Work in consultation with the Senior Legal Advisor to provide technical support to the JCE.
• Support the Secretariat in coordinating the work of consultants engaged by the JCE.
• Coordinate with the ICT department on digitalizing the bench book and/or updating the webpage / search engine for election petitions on the webpage.
• Provision of technical advice to the JCE Secretary in planning and organizing JCE members meetings
• Technical support in the operationalization and work of the JCE Sub-Committees.
• Attending JCE meetings where so requested by the JCE and providing legal technical support to the Chair and Secretary with regard to JCE meetings and those of its sub-committees.
• Perform any other tasks related to these TORs as advised by the JCE Secretary or Members.
• In carrying out the assignment, the consultant/s will work closely with:
• The relevant department from the Judiciary and the members and secretariat of the JCE.
• Election stakeholders and relevant state institutions, including the IEBC, ORPP or PPDT, Judiciary Training Institute and Commission for the Administration of Justice
• IFES technical staff and program staff
• The Expert/s will, at all times:
• Carry out the services and perform his/her tasks with care, skill and in an efficient and professional manner.
• Ensure a high degree of quality in his/her output.
• Be guided by these terms of reference.
• Carry out his/her tasks on the field, presenting outputs to JCE and IFES on/or before agreed deadlines in both soft and hard copy.

Qualifications
• Bachelor of Laws (LLB) degree from a recognized University
• Post graduate Diploma in Law
• Advocate of the High Court of at least three (3) years standing
• 3 years of professional experience
• Membership to Law Society of Kenya
• Skilled in program/project development & implementation
• Proficiency in computer applications
• Previous experience in elections in Kenya required
• Knowledge and understanding of judiciary, governance and democracy environment
• Experience working with international teams and providing logistical support and coordination, preferred.
