JOB DETAILS:
Job Purpose
• To provide legal advice and handle Security-Related Documentation and perfection in an efficient manner in order to ensure the Bank is adequately protected and support business in realization of the bank’s target on growth through disbursements of loans.
Responsibilities and Accountabilities
• Perfection of bank security documents by external lawyers within the agreed turn - around time by :
• Instructing lawyers upon receipt of Letter of Offer and the complete set of accompanying documents and duly completed security perfection checklist.
• Reviewing and forwarding security documents prepared by the lawyers to the client for execution through the BMs/RMs and to the external lawyers after execution.
• Review and verification of registered and perfected security documents on receipt from the external lawyers to ensure that the Bank’s interest is adequately protected and forwarding the same to the Securities Officer.
• Security Perfection by Internal Lawyers: Preparation of internally prepared securities, Guarantees and Indemnities, Chattels Mortgages, Letters of Pledge and Set Off, Memorandum of Deposit of Titles and other security documentation.
• Provision of Legal advice and Support Providing timely legal advice on varying issues as requested from time to time by the business teams and head office units and regular updates on compliance and legal requirements for registration of securities and any adverse information/developments that may jeopardize the Bank’s position
• Handling take Overs and Temporary Security Releases Management of matters requiring release of securities to ensure appropriate undertakings are obtained, full compliance with the terms of the undertakings and prompt and full payment of all outstanding amounts as appropriate.
• Reporting
• Maintaining and updating an accurate report on security perfection status and other matters being
• handled by the Legal team and ensuring circulation of the reports to all relevant stakeholders on a weekly basis
Minimum Requirements
• Bachelor of Laws degree (LL.B) from recognized university and duly admitted Advocate of the High Court of Kenya.
• At least 3-6 years post-admission experience in a busy law firm or bank, with demonstrated experience in conveyancing and commercial law background
• Demonstrated experience in decision making, interpersonal as well as problem solving skills.
• Strong corporate, conveyancing, and commercial law background; litigation an added advantage
• Registered and “active” member of the Law Society of Kenya)
