• ABOUT NANHRI
The Network of African National Human Rights Institutions (NANHRI) is a not-for-profit organization and regional umbrella body that brings together 44 National Human Rights Institutions (NHRIs) in Africa. NANHRI —whose Secretariat is based in Nairobi, Kenya — is registered under the laws of Kenya as an independent legal entity since 2007.
We work towards the establishment and strengthening of NHRIs in the African continent through capacity building to meet their objective of protecting and promoting human rights at the national level. We also facilitate coordination and cooperation amongst NHRIs and links them with other key human rights actors at the regional and international level.
We envision a continent with effective NHRIs; contributing to an enhanced human rights culture and justice for every African.
OVERVIEW OF THE ASSIGNMENT
At the 21st Extraordinary Session of the African Commission on Human and People’s Rights (ACHPR) (hereinafter referred to as the Commission), the Special Rapporteur on Prisons, Conditions of Detention and Policing in Africa was tasked to develop the Zero Draft Principles on the Decriminalization of Petty Offences in Africa (hereinafter referred to as the Principles).
The Commission approved the Principles at the November 2017 session and is set to officially launch the same in their 63rd Ordinary Session in October 2018.

PROPOSED TERMS OF REFERENCE FOR THE CONSULTANT
NANHRI CALL FOR EXPRESSION OF INTEREST IN CONSULTANCY TO FACILITATE AND ENHANCE THE ROLE OF AFRICAN
NATIONAL HUMAN RIGHTS INSTITUTIONS IN THE DECRIMINALIZATION OF PETTY OFFENCES IN AFRICA.
Drawing from the financial support from the Open Society Foundation (OSF), NANHRI is implementing a Pilot Phase project entitled, “Enhancing the Role of National Human Rights Institutions (NHRIs) in the Decriminalization of Petty Offences in Africa”, whose objective is to promote and support the role of NHRIs to undertake national and regional level interventions in the decriminalization of petty offences in Africa through development of National Action Plans.
RATIONALE:
The project stems from recognition of NHRIs’ mandate in the promotion and protection of human rights in compliance with the Paris Principles.
This interalia uniquely places them to undertake a holistic assessment of the criminal justice system and advise the states on their obligation to conform to regional and international human rights instruments which explicitly curb the vice of violation of fundamental human rights in all its dimensions.
It is against this backdrop that the NANHRI Secretariat seeks to procure the services of a Consultant to work closely with the responsible Programme Officer to build the capacity of five NHRIs namely: Cote d’Ivoire, Ghana, Kenya, Malawi and South Africa on their understanding on the ACHPR Principles in comparison to the practice at national level, and thereafter develop National Action Plans and guide the NHRIs in development of country specific Memoranda to influence policy reforms.
OBJECTIVES OF THE ASSIGNMENT
The overall objective of the assignment shall entail:
a) Act as the lead facilitator during the Project’s five trainings;
b) Working closely with the 5 NHRIs to develop National Action Plans to support the adoption and implementation of the Principles at National Level;
c) Provide guidance to the 5 NHRIs in the development of Memoranda for respective Parliaments to effect policy reforms in their Criminal Justice System;
d) Reporting to NANHRI Secretariat. In particular, the Consultant shall:
a) Analyze the individual NHRIs’ capacity in order to ascertain their compliance with the Paris Principles, institutional independence, strengths and weaknesses to effectively discharge their mandate.
b) Identify gaps and current work of NHRIs in relation to decriminalization of petty offences in Africa;
c) Enhance the capacity of the five NHRIs to undertake review of laws, policies and administrative measures in order to identify areas for reform in line with regional and international human rights standards in the decriminalization of petty offences;
d) Facilitate dialogue between NHRIs and other key actors in the criminal justice system including civil society organizations to explore alternative ways of dealing with petty offences.

The consultancy period shall be 30 days to undertake the assignment and submission of final documents.

SUBMISSION OF BIDS
An expression of interest should contain the cover letter, a technical proposal and a quote of the cost for the consultancy services. The technical proposal should also contain a resume with three professional references.
